Terms of Service

Effective date: 2026-05-22

§ 1. General provisions

  1. These Terms of Service govern the rules for using the fotodokarty.pl platform, placing orders, making payments, order fulfilment, filing complaints, exercising the right of withdrawal, and the rules for providing electronic services.
  2. The Seller and provider of electronic services is Rodion Baronov, address: Aleja Solidarności 68/121, 00-240 Warszawa, Poland, VAT ID (NIP): 7011263818, REGON: 541925970, e-mail: kontakt@fotodokarty.pl (hereinafter “Seller”).

§ 2. Definitions

  1. Customer — a natural person, legal person, or organisational unit without legal personality who uses the Service or places an order.
  2. Consumer — a natural person entering into a contract with the Seller for a purpose unrelated directly to their business or professional activity.
  3. Entrepreneur with consumer rights — a natural person operating a sole-trader business for whom the contract is not of a professional nature.
  4. Service — a digital service consisting of preparing a document photo by automatically processing the selfie supplied by the Customer and delivering a finished JPG file meeting the biometric requirements of MOS/ICAO 9303.
  5. Digital Content — the finished image file (JPG or set of files) produced as a result of the Service, including an optional print sheet (10×15 cm).
  6. Platform / Service — the website fotodokarty.pl and the associated Telegram bot t.me/FotoDoKartyBot, through which the Seller provides the Service.
  7. Business day — any day from Monday to Friday, excluding Polish public holidays.

§ 3. Type and scope of electronic services

  1. Through the Platform, the Seller provides electronic services including: a) browsing the content of the Platform; b) an order submission form in the Telegram bot; c) the ability for the Customer to submit a selfie for processing; d) communication via e-mail and the Telegram bot; e) delivery of the finished file or a download link.
  2. The Service is a paid digital service and supply of Digital Content within the meaning of consumer protection legislation.

§ 4. Technical requirements

  1. Use of the Service requires: Internet access, an active Telegram account, and an active e-mail address.
  2. The selfie must meet the requirements described in the Platform and the bot (including JPG or PNG format, size up to 20 MB, face visible in the frame, good lighting, no obstructions).
  3. The Customer must use the Platform in accordance with the law. Submitting photos of other persons without a proper legal basis, harmful files, or content that violates law, good customs, or intellectual property rights is prohibited.

§ 5. Service information and price

  1. The Seller publishes on the Platform a description of the Service, the gross price in PLN, the estimated processing time, and the method of delivering the digital result.
  2. The price of the Service is 17 PLN gross per order, unless the current price list states otherwise.
  3. Delivery of the result is digital — no physical shipping costs apply.
  4. Information about Services on the Platform constitutes an invitation to enter into a contract, unless explicitly stated otherwise.

§ 6. Placing orders and entering into a contract

  1. To place an order, the Customer: a) submits a selfie to the Telegram bot; b) accepts the Terms of Service and Privacy Policy; c) clicks a button bearing unambiguous text indicating an obligation to pay.
  2. Before finalising the order, the Customer sees at minimum: the main features of the Service, the full gross price, the estimated processing time, and links to the Terms of Service and Privacy Policy.
  3. The contract is considered concluded upon the Customer’s receipt of an order confirmation after successful payment authorisation.
  4. A confirmation of the contract on a durable medium will be provided to the Customer without undue delay after the contract is concluded.

§ 7. Payments

  1. Available payment methods: Telegram Stars (XTR) and, when active, Przelewy24 (BLIK, card, online transfer).
  2. If the Seller accepts payment via Przelewy24, the payment service operator is PayPro S.A. with its registered office in Poznań, ul. Kanclerska 15, 60-327 Poznań, operating under the brand Przelewy24.
  3. Payment is considered completed upon confirmation of the payment transaction in accordance with the technical integration used by the Seller.

§ 8. Order fulfilment and delivery of the result

  1. The Seller delivers the digital result within a few minutes of payment confirmation, unless the Service page states otherwise.
  2. The digital result is considered delivered once the file or its download link has been made available to the Customer via the Telegram bot.
  3. Result files are available for download for 24 hours from delivery, after which they are automatically deleted from the system.
  4. If the Customer’s selfie is technically unsuitable for the Service, the Seller may: request a new selfie, refuse to fulfil the order with a full refund, or complete the Service within the limits of objective technical possibilities if the Customer has explicitly given consent.

§ 9. Right of withdrawal

  1. A Consumer and — to the extent provided by law — an Entrepreneur with consumer rights is generally entitled to withdraw from a distance contract within 14 days of the date the contract was concluded.
  2. This right may not apply or may be lost in cases provided by law, in particular where the Customer has given prior consent to immediate commencement of the Service and acknowledged awareness of losing the right of withdrawal upon delivery of the Digital Content.
  3. If the Customer is entitled to withdraw, the withdrawal declaration must be submitted by e-mail to: kontakt@fotodokarty.pl or in writing to the Seller’s address.

§ 10. Complaints and conformity with the contract

  1. If the digital result or the Service does not conform to the contract, the Customer may file a complaint by e-mail to: kontakt@fotodokarty.pl or in writing to the Seller’s address.
  2. A complaint should contain at minimum: details enabling identification of the order, a description of the problem, the date on which it was identified, and the preferred resolution.
  3. The Seller shall in the first instance seek to bring the Service or result into conformity with the contract within a reasonable time.
  4. If bringing the result into conformity is impossible, disproportionately costly, or has not occurred within a reasonable time, the Customer may request a price reduction or — in cases provided by law — withdraw from the contract.
  5. The Seller will acknowledge receipt of a complaint without undue delay. The standard organisational response time is 14 days and represents a service standard; it does not limit the Customer’s statutory rights.

§ 11. Refunds

  1. In the event of an upheld complaint, successful withdrawal, or impossibility of performing the Service, the Seller will return amounts due without undue delay and no later than within the period required by mandatory applicable law.
  2. Refunds will be made using the same payment method, unless the Customer has agreed to a different method with no additional costs to the Customer.

§ 12. Liability

  1. No provision of these Terms of Service excludes or limits the rights of a Consumer or Entrepreneur with consumer rights guaranteed by mandatory applicable law.
  2. The Seller is liable for proper performance of the contract in accordance with applicable law.
  3. In relations with Customers who are not Consumers, the Seller’s liability for lost profits is excluded, and total liability — except for damages caused intentionally — is limited to the amount actually paid for the relevant order.
  4. The Seller does not guarantee that the finished photo will be accepted by any authority in cases where rejection results from circumstances beyond the Seller’s control, in particular the quality of the selfie supplied by the Customer or additional requirements of a specific authority not mentioned in the Service description. This disclaimer does not limit the Customer’s statutory rights regarding non-conformity with the contract.

§ 14. Out-of-court dispute resolution

  1. A Customer who is a Consumer may use the ODR platform available at: https://ec.europa.eu/consumers/odr
  2. The Customer may also contact the District Consumer Ombudsman or consumer organisations.

§ 15. Final provisions

  1. Polish law applies to contracts concluded under these Terms of Service, taking into account mandatory consumer protection provisions of the country of the consumer’s habitual residence.
  2. If individual provisions of these Terms of Service prove invalid, the remaining provisions remain in force.
  3. These Terms of Service enter into force on 2026-05-22.
  4. Previous versions of the Terms of Service are stored in a manner allowing their retrieval.
